OWN SET is a registered business name held by Pavel Zgrivets, sole trader, ABN 20229210545. "OWNSET" is the brand styling used on this website. In this Privacy Policy, "OWNSET", "we", "us" and "our" refer to the business operated by Pavel Zgrivets under the registered business name OWN SET.
We take privacy seriously. This Privacy Policy explains how we collect, hold, use and disclose personal information when you visit the OWNSET website, join an early-access or waitlist form, complete a survey, register interest as a trainer, contact us, book an introductory conversation or otherwise interact with our pre-launch services.
We aim to handle personal information consistently with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). Where that Act or another applicable privacy law applies to us, we will comply with those requirements.
This policy relates to OWNSET's current pre-launch website and validation activities. It does not yet cover information that may eventually be collected through operating OWNSET studios, member accounts, studio access systems, cameras, workout technology or other future services. We will update this policy before introducing material new forms of personal information collection.
1. What personal information we collect
The information we collect depends on how you interact with OWNSET.
Information you provide to us
This may include:
- your name
- email address
- telephone number
- suburb, postcode or preferred OWNSET location
- whether you are interested in using OWNSET personally, as a personal trainer, or in another capacity
- information about your current training or gym usage
- preferences about studio locations, equipment, session times or booking arrangements
- expected frequency of use
- pricing preferences or willingness to pay
- survey responses
- feedback, questions and other information you choose to give us
- for trainers, relevant professional or business information such as how you currently train clients and what type of facilities you use
- your marketing and communication preferences
- information associated with a booking, early-access request or reservation.
If OWNSET offers paid pre-launch reservations or deposits, we may also hold information such as the payment amount, payment status, transaction reference and refund status. Payment card or bank details will generally be processed by our payment provider rather than stored by OWNSET.
Information collected when you use our website
Our website and service providers may automatically collect technical and usage information including:
- IP address
- browser and device type
- operating system
- approximate location derived from network information
- pages viewed
- date and time of visits
- referring website
- website interactions
- campaign, referral and advertising information, including UTM parameters
- information used to detect bots, fraud, abuse or security threats.
Some of this information may constitute personal information when it can reasonably be linked to an identifiable person.
2. Health and other sensitive information
OWNSET's current pre-launch forms are not designed to collect medical or health information.
Please do not include information about medical conditions, injuries, medications, diagnoses or other sensitive health information in survey comments or general enquiry fields unless we specifically ask you for it in the future.
If sensitive information is provided to us unexpectedly, we will only use or retain it where reasonably necessary and permitted by law. Where appropriate, we may delete or de-identify information that we did not need to collect.
If OWNSET later begins collecting health, exercise-screening, biometric, body-composition or similar information as part of operating its studios or digital services, we will update our privacy practices and provide appropriate notice and consent arrangements before doing so.
3. How we collect personal information
We generally collect personal information directly from you when you:
- complete a form or survey
- join a waitlist or early-access list
- register interest as a trainer
- request information
- book a call or meeting
- communicate with us by email, telephone or another communication channel
- participate in user research
- make a reservation or payment, if that functionality is offered.
We may also collect limited information through website analytics, advertising platforms, referral links and security technologies.
Where you arrive at our website through an advertisement or campaign, we may receive or record information identifying the campaign, advertisement or source that led you to OWNSET.
4. Why we collect and use personal information
We may collect, hold and use personal information to:
- respond to enquiries
- manage waitlists, early access and expressions of interest
- understand demand for OWNSET
- assess potential locations
- understand the needs of trainees and personal trainers
- research pricing, equipment, session formats and product preferences
- plan, develop and improve OWNSET
- contact people who have asked to participate in further research
- arrange calls, interviews or meetings
- administer reservations, deposits and refunds where applicable
- operate, protect and improve our website
- prevent spam, bots, fraud and misuse
- measure website traffic and campaign performance
- understand which advertising or referral sources are effective
- communicate important information relating to an enquiry or registration
- send launch information or marketing communications where we have permission to do so
- comply with legal obligations
- establish, exercise or defend legal rights.
We may also aggregate or de-identify information so that it can be used for business analysis, demand forecasting and product development without identifying individual people.
We do not sell personal information or customer lists.
5. Marketing communications
Providing information to OWNSET does not automatically mean that you must agree to receive promotional communications.
Where required, we will ask separately whether you would like to receive launch news, offers or other marketing communications.
Where you have consented, or where communications are otherwise permitted by law, we may contact you by email, SMS or another agreed channel.
You can opt out at any time using the unsubscribe facility in a message or by contacting us.
We will action valid electronic marketing unsubscribe requests as soon as practicable and within the timeframe required by Australian law.
Opting out of marketing does not prevent us from sending non-promotional communications that are reasonably necessary to deal with an enquiry, reservation or other existing interaction with you.
6. Cookies, analytics and advertising technologies
OWNSET may use cookies and similar technologies for purposes such as:
- keeping the website functioning correctly
- security and bot prevention
- remembering basic preferences
- understanding website usage
- measuring advertising performance
- determining how visitors reached the website.
We may use third-party analytics or advertising services to understand website performance or measure campaigns.
Depending on how these services are configured, they may receive information such as IP address, browser information, device information, pages visited, campaign identifiers and website interactions.
OWNSET does not intend to send survey answers, free-text responses, health information or other sensitive information to advertising platforms.
Where appropriate, we may provide website visitors with choices regarding non-essential analytics or advertising technologies.
You may also be able to restrict or delete cookies using your browser settings. Some essential website or security functions may not operate correctly if essential technologies are disabled.
7. Who we may disclose information to
We may provide personal information to organisations that help us operate OWNSET, where reasonably necessary for the purposes described in this policy.
These may include:
- website hosting and infrastructure providers
- database and cloud service providers
- website security and anti-bot providers
- analytics providers
- email and communication providers
- customer or lead management systems
- survey and form providers
- scheduling providers
- payment processors
- advertising and campaign measurement providers
- professional advisers such as lawyers, accountants and insurers
- contractors who assist us with technology, research or business operations.
We seek to limit information provided to service providers to what is reasonably necessary for their role.
We may also disclose information:
- where you have authorised us to do so
- where required or authorised by law
- to prevent or investigate suspected fraud or unlawful activity
- where reasonably necessary in connection with legal proceedings or the protection of our legal rights
- in connection with a merger, acquisition, investment, restructuring or sale of all or part of the OWNSET business, subject to appropriate confidentiality and privacy protections.
We do not rent or sell personal information to third parties for their independent marketing purposes.
For the pre-launch forms, Cloudflare provides hosting and Turnstile spam protection, and Supabase provides database storage. If enabled, Resend sends an owner notification without the submitted personal details, and Google Analytics 4 measures page views and a small number of form interactions. We do not send names, contact details or questionnaire answers to Google Analytics.
8. Overseas processing and disclosure
Some of the technology providers used to operate modern websites and online services operate internationally.
As a result, personal information or associated website data may be processed in Australia and in overseas locations, including the United States, countries within Europe and Singapore.
Some internet security and content-delivery services process traffic dynamically through global infrastructure. In those circumstances it may not be practicable to identify every country through which limited technical information may be processed.
Where applicable privacy law requires us to take steps in relation to an overseas disclosure, we will take reasonable steps appropriate to the circumstances.
Where practical, we prefer to keep the primary database containing OWNSET pre-launch form submissions in Australia.
9. How long we retain information
We retain personal information only for as long as it is reasonably required for the purposes for which it was collected, for a related permitted purpose, or as required by law.
For example:
- waitlist and early-access information may be retained while OWNSET is being developed and launched
- research responses may be retained while they remain useful to our product and business research
- enquiry records may be retained for a reasonable period after the enquiry is completed
- transaction and accounting records may need to be retained for legally required periods
- records of marketing consent, withdrawal or suppression may be retained where necessary to demonstrate consent or ensure that someone who has opted out is not contacted again.
Where personal information is no longer reasonably required, we will take reasonable steps to delete it or de-identify it, subject to legal and technical requirements.
We may retain aggregated or genuinely de-identified information indefinitely because it no longer identifies an individual.
10. How we protect personal information
We use reasonable technical and organisational safeguards appropriate to the information we hold.
These may include:
- encrypted connections
- access controls
- restricting administrative access
- server-side processing of form submissions
- security and anti-bot controls
- logging and monitoring
- backups
- using established service providers
- limiting access to people who require the information for their work.
No internet transmission or storage system can be guaranteed to be completely secure, but we take reasonable steps to reduce the risk of loss, misuse, interference, unauthorised access, modification or disclosure.
If a data breach occurs, we will assess and respond to it in accordance with applicable law. Where the Notifiable Data Breaches scheme applies and notification is required, we will notify affected individuals and the Office of the Australian Information Commissioner as required.
11. Accessing or correcting your information
You may contact us if you would like to:
- ask what personal information we hold about you
- request access to it
- correct information that is inaccurate, incomplete, out of date, irrelevant or misleading
- ask us to delete information that we are not required or entitled to retain
- withdraw a consent you previously provided.
We may need to verify your identity before providing access to or changing personal information.
We aim to deal with access and correction requests within a reasonable period, generally within 30 days.
There may be circumstances where we are permitted or required to refuse access, correction or deletion. If this occurs, we will explain our decision where required by law.
12. Dealing with us anonymously
You may browse most parts of the OWNSET website without identifying yourself.
However, we may need identifying or contact information where it is necessary to respond to an enquiry, join a waitlist, arrange a call, administer a reservation or provide another requested service.
13. Automated decision-making
OWNSET does not currently use personal information collected through its pre-launch website to make solely or substantially automated decisions that could reasonably be expected to significantly affect a person's rights or interests.
If that changes, we will update this policy and provide any additional information required by applicable privacy law.
14. Privacy complaints
If you have a concern about how OWNSET has handled your personal information, please contact us using the details below.
Please provide enough information for us to understand and investigate the issue.
We will take privacy complaints seriously and aim to respond within a reasonable period, generally within 30 days.
If you are not satisfied with our response and the Privacy Act 1988 (Cth) applies to the matter, you may be able to complain to the Office of the Australian Information Commissioner (OAIC).
Where a matter relates to health information in New South Wales and the Health Records and Information Privacy Act 2002 (NSW) applies, you may also have rights through the Information and Privacy Commission NSW.
15. Third-party websites
Our website may contain links to external websites or services.
OWNSET is not responsible for the privacy practices of third parties. We recommend reviewing the privacy information provided by those organisations when leaving the OWNSET website.
16. Changes to this Privacy Policy
OWNSET is still developing, so our information-handling practices may change as the service evolves.
We will update this Privacy Policy where there is a material change to the personal information we collect or how we use, store or disclose it.
The "Last updated" date at the beginning of this policy shows when it was most recently revised.
We will provide additional notice where required by law or where a change is significant enough that additional notice is appropriate.
